RecommendME – Terms of Service

Please read these Terms of Service (“Terms”) carefully before accessing or using the RecommendME platform. By registering for, accessing, or using our service, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.

1. Service Description

RecommendME is a referral-based marketing platform that enables small business owners, sole traders, and service providers to promote their services through customer-generated referrals using a branded QR code. The platform provides:

A personalised QR code and digital referral page
Referral tracking and basic analytics
Subscription-based access with optional support

RecommendME does not guarantee leads, sales, or income. It is a tool to support referral visibility, not a direct client acquisition service.

2. Eligibility for Use

To use RecommendME, users must:

Be 18 years of age or older
Operate a lawful business or service in Australia
Provide complete and accurate information at the time of registration
Use the platform in accordance with all applicable federal, state, and local laws

We reserve the right to verify the legitimacy of any user or business and to refuse access at our sole discretion.

3. Account Registration & Access

Upon registration, users are provided with:

A unique QR code linked to their digital referral page
Access to update business and profile information

Users are responsible for all activity conducted under their account and for safeguarding login credentials. You must notify us immediately of any unauthorised use or suspected breach.

4. Subscription Plans & Payment Terms

RecommendME operates under a recurring subscription model:

Monthly Plan: AUD $29/month
Yearly Plan: AUD $312/year (prepaid)

Subscription fees are billed automatically via secure payment gateways. Users may cancel the monthly plan at any time before the next billing date. Annual plans are non-refundable and fixed for the 12-month period. No refunds or credits are provided for partial months or unused features.

5. User Responsibilities

Users agree to:

Use the QR code and referral system only for their own legitimate business promotion
Not sell, sublicense, share, or misrepresent the service
Treat referred customers with honesty, respect, and professionalism
Not post or share misleading offers, false claims, or illegal content via the platform

Any misuse may result in immediate suspension or permanent account termination without notice or refund.

6. Referral Outcomes & Customer Engagement

The RecommendME platform is a tool to facilitate referrals. Users are solely responsible for:

Managing their own business operations and client service
Honouring any promotional offers they choose to share
Following up on referred leads professionally and lawfully

RecommendME makes no representations regarding client acquisition, lead quality, or business growth.

7. Data Collection & Privacy

By using this platform, users consent to the collection, storage, and use of business and personal information as outlined in our Privacy Policy.

We only collect data necessary for service provision, platform improvements, and user communication.
We do not sell or distribute user or client data to any third parties unless legally required.
Users are responsible for handling any personal data they collect from referrals in accordance with Australian privacy laws (Privacy Act 1988).

8. Intellectual Property

All software, content, branding, and referral mechanisms within RecommendME are the exclusive intellectual property of RecommendME Pty Ltd.
Users retain ownership of their own business name, logo, and service branding. However, the platform, QR generation system, referral dashboard, and supporting technologies remain solely owned by RecommendME.
Copying, modifying, or reverse engineering the service is strictly prohibited.

9. Disclaimers & Limitation of Liability

To the maximum extent permitted by law, RecommendME disclaims all warranties and liabilities. Specifically:

The service is provided on an “as-is” and “as-available” basis
We do not guarantee results, leads, revenue, or customer acquisition
RecommendME is not liable for:
- Business losses, client disputes, or revenue shortfalls
- Missed referrals, QR scanning errors, or third-party software issues
- User conduct, fraud, or misuse of the system

By using RecommendME, you waive any right to claim damages (direct or indirect) arising from your use of the platform.

10. Service Changes & Updates

We may modify, update, or discontinue the platform (or parts of it) at any time, with or without notice.
Terms may be updated periodically. Continued use of RecommendME after any revisions signifies acceptance of the updated Terms.

11. Termination & Account Closure

We reserve the right to suspend or terminate accounts that:

Violate these Terms
Use the platform in a harmful, abusive, or unlawful manner
Fail to comply with payment obligations

Upon termination:

Your QR code and referral page will be disabled
No further access or subscription credits will be provided

You may cancel your subscription anytime (except for annual prepaid plans) by contacting us via email.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of Australia. Any disputes arising from or relating to these Terms shall be exclusively resolved in the courts of Western Australia.

13. Indemnity & Waiver

You agree to indemnify and hold harmless RecommendME Pty Ltd, its employees, directors, and partners from any claims, losses, damages, or legal fees resulting from your:

Breach of these Terms
Misuse of the service
Disputes with customers or third parties
Violation of laws or regulations while using the platform
